Zamoori — Terms and Conditions
These Terms and Conditions apply to all purchases made through the website under the domain name www.zamoori.co.uk (the “Site”). By placing an order on the Site, you are entering into a contract with Zamoori (“we”, “us”, “our”) on the terms set out below.
1. Product Descriptions and Specifications
All products are described as accurately as possible. Images and product information are for illustrative purposes only and are not contractually binding. We reserve the right to make changes to product specifications where necessary to comply with legal or regulatory requirements, provided that such changes do not materially affect the quality or performance of the goods.
2. Pricing and Availability
All products offered are subject to availability. Prices displayed on the Site are in UK Pounds Sterling, inclusive of VAT, but exclusive of delivery charges unless otherwise stated. The price charged will be the price current at the time of your order.
We reserve the right to amend prices without notice. If you have selected the incorrect geographical delivery zone, we reserve the right to adjust your order and invoice you for the correct amount or refund any overpayment.
As we sell across multiple platforms, there may be occasions where we need to offer a refund or credit due to an item being out of stock, due to being sold elsewhere.
3. Order Process and Contract Formation
By clicking the “Submit Order” button at checkout, you are making an offer to purchase goods subject to these Terms and Conditions. You are responsible for ensuring that your order is accurate. If we accept your offer, a binding contract will be formed upon our confirmation, sent by email.
We reserve the right to refuse orders, limit quantities, or cancel orders in our sole discretion, including where the delivery name or address differs materially from the billing details.
4. Delivery and Risk
Goods will be delivered to the address provided during the order process. Risk in the goods passes to you upon delivery, even if the goods have not been received in person. Any delivery times provided are estimates only. We shall not be liable for any delay or failure in delivery due to events beyond our control.
5. Cancellation and Returns
5.1 Made-to-Order Goods
All fragrance sample orders placed via the Site are prepared specifically to your selected size (e.g. 1ml, 2ml, 5ml, 10ml, 15ml). These are not held in stock and are filled to order. As such, they fall under the exemption in Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and are excluded from the standard right to cancel.
We therefore cannot accept cancellations or returns for these products once preparation has begun, unless the product is faulty or not as described.
5.2 Discretionary Cancellation Period
As a goodwill gesture, we may, at our sole discretion, allow cancellation requests within 24 hours of order placement, provided that preparation has not yet commenced. This is not a statutory right and may be withdrawn at any time.
5.3 Other Non-Returnable Items
You may not return or cancel your order if it is for:
(a) Products dependent on financial market fluctuations beyond our control;
(b) Products made to your specifications or personalised;
(c) Products purchased in bulk (6 units or more of a single item), which are considered final sale;
(d) Products that have been opened, used, or unsealed;
(e) Products that are unsuitable for return due to health or hygiene reasons once unsealed, in accordance with Regulation 28(3)(a);
(f) Products returned without prior agreement or outside of the timeframe agreed.
5.4 Faulty Goods
In accordance with the Consumer Rights Act 2015, if goods are faulty or not as described, you may be entitled to a repair, replacement, or refund. In such cases, we will reimburse reasonable return postage costs.
6. Personal Data and Privacy
We are committed to protecting your privacy. We process your personal data in accordance with UK GDPR and the Data Protection Act 2018. Your data will only be used to fulfil your order and communicate with you, unless otherwise agreed. For more detail, please refer to our separate [Privacy Policy].
We do not store your payment card details. All payment processing is handled securely via our payment provider.
7. Fragrance Disclaimer
Zamoori is not affiliated with, endorsed by, or sponsored by any fragrance brand whose products may appear on the Site. All logos, names, and trademarks remain the property of their respective brand owners.
We decant genuine fragrances into our own Zamoori packaging and clearly label them accordingly. Customers receive the original fragrance liquid, rebottled independently into sample sizes, not in retail-branded bottles.
8. Prohibited Uses
You must not use the Site:
- For any unlawful purpose;
- To solicit illegal activity;
- To infringe intellectual property rights;
- To harm, abuse, or harass others;
- To transmit viruses or malicious code;
- To collect or misuse personal data;
- For any resale or commercial purpose not authorised by us.
We reserve the right to suspend or terminate access to our services for any misuse.
9. Limitation of Liability
We do not guarantee that the Site will be secure, error-free, or uninterrupted. All products and services are provided “as is” and “as available”. We exclude all implied warranties to the fullest extent permitted by law.
To the extent permitted by law, we shall not be liable for any indirect, incidental, or consequential loss or damage (including loss of profits, revenue, or data) arising from use of our services or products. Our liability for any claim shall not exceed the amount you paid for the relevant product.
10. Indemnity
You agree to indemnify, defend and hold harmless Zamoori, its directors, employees, agents, suppliers, and affiliates from any claim, liability, damage, or expense arising from your breach of these Terms or your use of the Site or services.
11. Changes to Terms
We may update these Terms from time to time. The version published on the Site at the time of your order will apply to that order. Your continued use of the Site constitutes acceptance of the latest version.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
DISCLAIMER
Genuine fragrances rebottled by an independent bottler, Zamoori. The fragrance is taken from genuine retail products and is entirely independent of the original manufacturing brand. Zamoori is in no way affiliated with, or working in any form of partnership with, the brand owner. All fragrances are 100% original but will not be supplied in any retail/branded packaging and no trademarks or logos will be used.
